BUITONI® REFRESH WITH PESTO CONTEST

CONTEST IS OPEN TO LEGAL RESIDENTS OF THE 50 UNITED STATES AND THE DISTRICT OF COLUMBIA 18 YEARS OF AGE AND OLDER AND SHALL BE CONSTRUED AND EVALUATED ACCORDING TO U.S. LAW. DO NOT ENTER THIS CONTEST IF YOU ARE NOT LOCATED IN THE 50 UNITED STATES OR DISTRICT OF COLUMBIA.

TO ENTER: Log on to www.Buitoni.com/HolidayPestoPromo between 12:01 a.m. ET 11/09/07 and 11:59pm ET 01/02/08 and follow on-screen instructions to register and submit your recipe and related information, which must meet the criteria outlined below ("Entry" or "Entries"). Contest ends, and all Entries must be received by 11:59 pm ET 01/02/08. All entrants ("Entrants) must have a valid e-mail address. In case of dispute as to identity of the winner who enters, entry will be declared made by the registered user (meeting eligibility criteria ("Eligibility Criteria"), as defined below) of the e-mail account, and if a prize is won, it will be awarded to that registered user. By submitting a recipe and related information, Entrants are agreeing to their Entries being governed these Official Rules, and to the decision of the judges, which is final. Enter as often as you wish, but each entry must satisfy the Eligibility Criteria and be entered online separately. All Entries, including recipe and Paragraph (as defined below) become the property of Sponsor, as defined below. Entries generated by a script, macro or other automated means will be disqualified. Sponsor is not responsible for lost, stolen, illegible, misdirected, or late submissions.

CONTEST PREMISE: That the addition of pesto to a long-used recipe can create something new and different.

ELIGIBILITY CRITERIA: Entry is governed by and must meet all of the following requirements or it will be disqualified:

Entry must include a valid e-mail address, which we may use to contact you.
Recipe(s) entered can be for any of the following dishes: appetizer, salad, soup, entrée or side dish.
Each recipe must be named, original, unpublished, the sole property of submitter and not previously submitted in any other contest.
Ingredients must be listed in exact common U.S. household measurements in order of use, followed by step-by-step preparation instructions, cooking and baking times, temperatures and number of servings.
Sizes of cooking pots or baking pans and casserole dishes must be included.
Each Entry must include an explanatory paragraph ("Paragraph") of 150 words or less describing why the recipe is important to you and/or your holiday meal, and why it needs to be refreshed.
The holiday occasion at which the dish is primarily served must be specified.
All recipes entered into the contest and all rights to use, reproduce and distribute such recipes become the exclusive property of Sponsor, will not be returned and may be used by Sponsor or its affiliated companies or agents in any manner and for any lawful purpose whatsoever, worldwide and in perpetuity. By submitting a recipe, Entrant understands and accepts these Official Rules and agrees to be bound by the decision(s) of the judges, which are final. Sponsor reserves the right to edit, modify, adapt, copyright, publish, use and reproduce any and all Entries without further compensation.

JUDGING: Judging will be done by a panel of culinary professionals. All Entries will first be judged with a view to how pesto can improve or update the recipe. All Entries will be judged on the basis of appeal (25%), originality (25%), appropriateness for a special occasion (25%), and a subjective determination of refresh need (25%). Ten (10) finalists will be chosen. The ten (10) finalists' recipes will then be reviewed a second time based on the Eligibility Criteria and a Grand Prize winner will be selected. At the judges’ discretion, Entries that include unsuitable content or that are in violation of third party rights (including, but not limited to, copyrights) will be immediately disqualified.

Limit one (1) winner per household, home address or email address. No cash substitutions for prizes will be permitted and prizes are non-refundable and non-transferable except at sole discretion of Sponsor. Sponsor reserves the right to substitute prize of equal or greater value. Federal, state and local taxes are the sole responsibility of the winner. Total ARV for all prizes is $6,350.00.

If the prize is won by an eligible individual who is not of the legal age of majority in the state of residence, the required documents must be confirmed and signed by winner's parent or legal guardian, and the prize will be awarded in the name of winner's parent or legal guardian who will be required to fulfill all requirements imposed on winner set forth herein.

NOTIFICATION: Finalists will be notified by mail on or about January 31, 2008. Finalists may be required to sign and return Sponsor's forms (Winner's Agreement and Liability Release and, where legal, a Publicity Release) within fourteen (14) days of notification or another finalist will be selected. If any prize or prize notification is returned as non-deliverable, prize will be forfeited and an alternate prize winner will be selected.

ELIGIBILITY: Contest open to legal residents of the 50 U.S & DC, 18 years or older, except employees and the families of Nestlé USA, their affiliates, subsidiaries, promotions and advertising agencies. Nestlé USA and their affiliated companies, representatives, agents or employees are not responsible for, and shall be indemnified by the prize winner against, any claims, injuries, losses or damages of any kind resulting from acceptance, use, misuse, possession, or loss of the prize. Void where prohibited or restricted by law. Subject to all federal, state and local laws.


GENERAL: By entering the Contest, Entrant accept and agrees to these rules and the decision of the judges, which shall be final. By submitting an entry, entrant agrees to allow use of his or her name, city, state and/or photograph, recipe and related information for advertising this or similar promotions (including internet posting) without compensation unless prohibited. All entries and all rights of ownership and publication of same will become the property of Sponsor and will not be returned. By submitting an entry, entrant agrees that Sponsor may edit and publish/post recipe.


OTHER CONDITIONS: Sponsor assumes no responsibility for computer system, phone line, hardware, software or program malfunctions or other errors, failures of any kinds, delayed computer transmissions or network connections that are human or technical in nature. Sponsor reserves the right in its sole discretion to cancel or suspend this Contest, in its entirety or in part should virus, bug, tampering, unauthorized intervention, fraud, technical failures, or other causes beyond Sponsor’s control corrupt the administration, security, fairness, integrity or proper play of the Contest. Sponsor is not responsible for incorrect or inaccurate entry information whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Contest by a technical or human errors, which may occur in the processing of the entries in the Contest. Sponsor is not responsible for mail that is lost, late, stolen, illegible, misdirected, incomplete or mutilated. Sponsor reserves the right to withdraw the transmission of this contest at any time and award the prize from among eligible entries received prior to the date of the withdrawal. Sponsor reserves the right at its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the game or web-site or to be acting in violation of the Official Rules.
