The Ruffino-Barilla Culinary Challenge

ELIGIBILITY:

The Ruffino-Barilla Culinary Challenge (“Contest”) is open to legal residents of the 50 United States and District of Columbia (except California and Tennessee), who are 21 years of age or older at time of entry. <> Entries from professional chefs, chefs in training or culinary professionals (any person who has ever been paid by an unrelated person to prepare food) will not be considered. Void where prohibited by law. Officers, directors and employees of Ruffino SpA and Icon Estates (“Sponsors”), their affiliates, subsidiaries, licensed alcoholic beverage retailers and wholesalers, and other alcoholic beverage licensees, advertising and production agencies, electronic media firm, Barilla America, Inc., Sweepstakes Consulting, LLC, and members of their immediate families and those living in the same household are not eligible to participate. All federal, state, and local laws and regulations apply.

TO ENTER:

·         a. Create a pasta recipe using one package of Barilla pasta and one package of Barilla sauce, and your favorite fresh ingredients(s). The recipe must list all ingredients in exact common U.S. household measurements, preparation instructions and cooking times. Recipes must be the original work of the contestant, may not have won previous awards, may not have been previously published and must not infringe any third-party rights.

·         b. Tell us which Ruffino wine pairs best with your recipe and why in 25 words or less.

·         c. Complete the online entry form found at www.whatscookinginitaly.com.

·         d. Submit your recipe, wine pairing suggestion & completed entry form between 12:01 a.m. Pacific Time (“PT”) on 7/1/08 and 11:59 p.m. PT on 12/31/08. Limit of one entry per person or email address. If more than one entry is received from the same person or email address, only the most current submission will be acknowledged.

JUDGING:

Winners will be determined by or before 4/1/09 by an independent panel of judges under the supervision of an experienced culinary professional(s) selected by Sponsor based on (a) taste (50%), (b) appearance (20%), (c) originality (10%), (d) ease of preparation (10%), and (e) wine pairing to recipe suggestion (10%). The top five recipes will be prepared by Barilla chefs and blind tasted by the judging panel to determine the ranking of the five winners. In the event of a tie, the tied entries will be re-judged by an additional judge who will serve as a tie-breaker using the same criteria as outlined herein. In the event that more than one contestant submits the same recipe, only the first entry received will be judged. All prizes may not be awarded in the event an insufficient number of entries are received that meet the minimum standards established by the judges.

CONDITIONS OF ENTRY:

By submitting a recipe in this contest (“recipe”), you hereby grant Sponsor an irrevocable nonexclusive, perpetual, worldwide, royalty-free right and license to use, display, publicly perform, modify, reproduce, publish, distribute, make derivative works of, sublicense and otherwise commercially and non-commercially exploit your recipe and all copyright, trade secret, trademark or other intellectual property rights therein, in any manner or medium now existing or hereafter developed, including but not limited to print, film or electronic storage devices, without separate compensation to or permission by you or any other person or entity. You hereby represent and warrant that (a) you have all necessary right, power and authority to grant the license set forth herein to your recipe and (b) your recipe does not violate, misappropriate or infringe any copyright, trade secret, trademark or other intellectual property right of any other person or entity. You will take, at Sponsor’s expense, any further action, including without limitation execution of affidavits and other documents, reasonably requested by Sponsor to effect, perfect or confirm the license granted to Sponsor to your recipe as set forth herein. In exchange for the license to your recipe, if published, used and/or posted on Sponsor’s site, said site will include your first name and last initial in conjunction with such publication, posting or use. By submitting a recipe, you hereby grant Sponsor the right to use your name and photograph/likeness in connection with the publication, use or posting of your recipe. You will include your name and telephone number with your recipe so that Sponsor can contact you if Sponsor has any questions about your recipe; however, only your first name and last initial will be published with your recipe if so indicated by you on your recipe.

PRIZE (1) and approximate retail value (“ARV”): Trip for two people to Italy consisting of roundtrip coach airfare from the major commercial airport nearest winner’s residence to a Sponsor selected airport in Italy, one standard hotel room (double-occupancy) for two nights at Academia Barilla cooking school for culinary lessons for two, ground transportation from Bologna, Italy to Parma, Italy, ground transportation from Parma, Italy, to Florence, Italy, one standard hotel room (double-occupancy) for four nights in Florence, and a one-day excursion to a Ruffino estate in Tuscany ($15,000 ARV, depending on itinerary). Prize does not include alcohol. Any expenses not mentioned above are the winner’s responsibility. Trip must be completed by 12/15/09. Winner’s travel companion must be age 21 or older, must travel on the same itinerary and must complete a Liability/Publicity Release prior to the issuance of travel documents. Winners and their winning recipes will be published atwww.whatscookinginitaly.com.

WINNER will be notified by mail and required to complete an Affidavit of Eligibility and Liability/Publicity Release, which must be returned within 14 days of the date on the notification or a runner-up will be determined. Any prize notification or prize returned as undeliverable will be awarded to a runner-up. No substitution for prize, unless at Sponsor’s sole discretion. Prize is not transferable or redeemable for cash. All federal and local taxes are the winner’s responsibility. Prize acceptance constitutes permission (except where prohibited) to use winner’s name, photographs, likeness and winning recipe for advertising and publicity purposes without additional compensation.

GENERAL: Sponsor and its agents are not responsible for any liability associated with the acceptance or use of or inability to use a prize. Sponsor and its agents are not responsible for lost, late, misdirected, damaged, incomplete, illegible or postage-due entries or Internet technical, hardware, software, telephone, or transmission failures of any kind, which may limit a person’s ability to enter the sweepstakes. Sponsor and its agents are not responsible for any injury or damage to entrants’ or any other person’s computer related to or resulting from entering or downloading any materials in the sweepstakes. Sponsor reserves the right to cancel or suspend advertising the sweepstakes on the Internet should a computer virus, unauthorized intervention or other cause corrupt the integrity or proper conduct of the promotion. Sponsor reserves the right to disqualify any entrant found to be disrupting the operation of the sweepstakes or its web site. In the event of a dispute as to the identity of any online entrant, entrant will be deemed the individual named on the online entry form. No transfer or assignment of entries is permitted. Entries become the sole property of the Sponsor.
